Terms Acceptance

By accessing, browsing, or otherwise using the website located at nv-casino.ie (hereinafter referred to as "the Website"), operated by Mountberg B.V. (hereinafter referred to as "the Company"), the user (hereinafter referred to as "the User") is deemed to have read, understood, and unconditionally accepted all terms, conditions, provisions, and obligations set forth within this User Agreement (hereinafter referred to as "the Agreement"). This Agreement constitutes a legally binding contract between the User and the Company. Access to and use of the Website shall be conditioned upon the User's full acceptance of and compliance with this Agreement. Should the User disagree with any provision contained herein, the User is required to cease all use of the Website immediately. The Company reserves the right to amend, modify, or update this Agreement at any time without prior notice. Continued use of the Website following the publication of any such amendments shall be construed as the User's acceptance of the revised terms. The User is advised to review this Agreement periodically to remain informed of any changes. The Agreement is entered into in accordance with the laws and regulatory framework governing the operations of Mountberg B.V., which is licensed and regulated under Curaçao Gaming License No. 8048/JAZ. By proceeding with the use of the Website, the User affirms that they are of legal age as required by the applicable jurisdiction and that they possess the legal capacity to enter into binding agreements.

Use of Website

The Website is made available solely for lawful purposes and in strict accordance with the terms of this Agreement. The User is permitted to access the Website for personal, non-commercial use, subject to full compliance with all applicable laws, regulations, and the provisions herein. Any use of the Website that is determined to be unlawful, fraudulent, harmful, or otherwise contrary to the terms of this Agreement is strictly prohibited. The following activities are expressly forbidden and shall constitute a material breach of this Agreement: (i) the transmission or dissemination of any content that is defamatory, obscene, offensive, or otherwise objectionable; (ii) the use of automated systems, bots, scrapers, or any other software designed to access or extract data from the Website without the express written consent of the Company; (iii) any attempt to gain unauthorized access to any part of the Website, its servers, or any related systems or networks; (iv) the introduction of viruses, malicious code, or any other harmful material that may disrupt or interfere with the functioning of the Website; (v) the use of the Website in any manner that may cause damage to the reputation or interests of the Company; (vi) the reproduction, duplication, or exploitation of the Website or its content for commercial purposes without prior written authorization. The Company reserves the right to suspend or permanently terminate the User's access to the Website at its sole discretion, without prior notice, in the event that any prohibited activity is identified or suspected. The User agrees to indemnify the Company against any claims, losses, or damages arising from the User's misuse of the Website.

Intellectual Property

All intellectual property rights in and to the Website, including but not limited to its design, layout, structure, source code, graphics, images, logos, trademarks, service marks, text, and all other proprietary content (hereinafter collectively referred to as "the Content"), are owned by or licensed to Mountberg B.V. All such rights are expressly reserved. Unauthorized use of the Content may give rise to claims for damages and may constitute a criminal offense under applicable intellectual property legislation. The User is permitted to print or download extracts from the Website solely for personal, non-commercial use, provided that no modifications are made to such materials and that all copyright and proprietary notices are preserved. Any use beyond the scope of this limited authorization shall require the prior written approval of the Company.

Limitation Notice

Limitation of Liability

To the maximum extent permitted under applicable law, Mountberg B.V., its directors, officers, employees, agents, licensors, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with the User's access to or use of the Website, regardless of whether such damages were foreseeable or whether the Company had been advised of the possibility of such damages. This limitation of liability applies to, without limitation: (i) loss of revenue or profits; (ii) loss of business or commercial opportunity; (iii) loss of data or information; (iv) loss of goodwill or reputation; (v) any damage resulting from unauthorized access to or alteration of the User's data or transmissions; (vi) any matter beyond the Company's reasonable control. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, the Company's liability shall be limited to the greatest extent permitted by applicable law. The User agrees to indemnify, defend, and hold harmless Mountberg B.V. and its respective directors, officers, employees, agents, and licensors from and against any and all claims, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to the User's use of the Website, the User's breach of this Agreement, or the User's violation of any applicable law or regulation. The Company's total aggregate liability to the User for any claims arising in connection with this Agreement shall not exceed the greater of the amounts paid by the User in connection with the Website in the twelve months preceding the claim or one hundred euros (€100).

Applicable Law

This Agreement, and any dispute, controversy, or claim arising out of or in connection with it or its subject matter or formation, including any non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of Curaçao. The operations of the Website are conducted by Mountberg B.V. under the authority of Curaçao Gaming License No. 8048/JAZ, and all regulatory obligations arising thereunder are to be observed and enforced in accordance with the relevant provisions of that jurisdiction. The User acknowledges that by accessing the Website, they do so voluntarily and are solely responsible for ensuring that their use of the Website is in compliance with the laws of their own jurisdiction. The Website is not intended for use in any jurisdiction where such use is prohibited by law or regulation. In the event that any provision of this Agreement is found to be invalid, unlawful, or unenforceable under the laws of any relevant jurisdiction, such provision shall be severed from the Agreement to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The failure of the Company to enforce any provision of this Agreement shall not be construed as a waiver of such provision or of the right to enforce it at a future time.
